Appeal court declares Senator Dino Melaye's election retrial

                           

The court of Appeal has orders retrial of Senator Dino Melaye's Election victory case by setting aside the election tribunal decision to strike out the petition of Sen Smart Adeyemi.
He has initially challenged the victory of Dino Melaye ,alleging election Irregularities and malpractice.

The appeal court sitting in Abuja referred the case back to the Tribunal for re-trial on merit,Justice Mohammed Adume of the Abuja Appeal court ruled that the Tribunal was wrong for striking out the Adeyemi's Petition on the Ground of Technicalities instead of Substantial Justice.
The court also held that the decision of the Tribunal that Adeyemi did not submit his petition within the time frame was wrong and hereby nullified. Adume said there was no enough evidence by the respondent  before the tribunal that the petition was late.
The tribunal Chairman, Justice Akon Ikpeme, had in the ruling of June 18, held that the Kogi West ex-Senator’s case was “incurably defective’’.
